Activities producing listed waste is an activity of environmental significance and generally facilities undertaking this activity need to have an EPA licence. Such facilities will have details on how the listed waste produced should be managed according to the conditions of that licence.
The Environment Protection (Waste to Resources) Policy 2010 (W2R EPP) contains specific provisions for disposal of listed waste by the following unlicensed activities:
- a domestic activity (unless the listed waste is placed in a kerbside collection, provided the council’s policy allows for that kind of waste to be disposed of in that manner)
- an activity in which the waste produced is lawfully disposed of to a sewer
- an activity consisting only of sorting or distributing goods
- building work
- carpentry or joinery
- retail pharmacy
- film processing
- plumbing or gas fitting
- dry cleaning
- primary or secondary school education
- agriculture or horticulture
- french polishing
- manufacturing jewellery
- painting or decorating
- panel beating and associated spray painting
- an activity producing waste oil at a rate less than 50,000 L per year.
These requirements are that:
- if the listed waste is removed by a waste transporter, the facility must ensure that the transporter is authorised to transport that kind of waste
- the facility must take reasonable steps to ensure that the waste is transported to an appropriate licensed or approved depot.
