Licence fee structure - consultation process

Thank you to all those who submitted responses to the EPA discussion paper on draft details of the licence fee structure. Your comments are valuable to us and have assisted the EPA, the Licence Fee Structure (LFS) Reference Group, the LFS Steering Committee and the EPA Board in providing sound advice to the Government who have finalised and endorsed the review.

The Reference Group consists of representatives from the Engineering Employers Association, SA Wine Industry Association, SA Water, Business SA, SA Chamber of Mines and Energy, energy sector in the Port River region, Local Government Association, Department for Trade and Economic Development, Environmental Defenders Office, Waste Management Association, SA Farmers' Federation and the Northern Industry Environmental Forum.

A letter, fax or email was sent to all respondents, thanking them for their submissions.

Consultation process

During the consultation period, a discussion paper was sent to the following groups:

  • all licensees—sent to the address on the licence
     
  • other South Australian government departments—Primary Industries and Resources South Australia, Department of Treasury and Finance, Department of Trade and Economic Development, SA Water and Department for Environment and Heritage
     
  • all members on the Licence Fee Structure Reference Group
     
  • prescribed bodies and other associations—Australian Conservation Foundation, Conservation Council of SA, Local Government Association, SA Chamber of Mines and Energy, Business SA, SA Farmers Federation, Engineering Employers Association, Waste Management Association of Australia, SA Wine Industry Association
     
  • interstate EPAs.

The discussion paper, consultant report and an online consultation forum were available on the EPA website.

In addition, a media release was issued and advertisements were placed in the public notices of the Advertiser, Messenger and regional newspapers.

Public workshops were advertised in newspapers and local radio stations, and were held at the following venues:

  • Port Lincoln
  • Port Augusta
  • Barossa Valley
  • Victor Harbor
  • Adelaide (Marion)
  • Adelaide (Port River area)
  • Mt Gambier
  • Riverland (Berri).

In addition to the public workshops, a workshop was also held at Business SA. A total of 80 people attended the nine workshops.

Analysis of submissions

The EPA consulted with all stakeholders about the details of the draft licence fee structure in May and June 2006. A total of 93 responses were received in the following formats:

  • letter posted (14%) or faxed (1%)
  • discussion paper form filled in and posted (9%) or faxed (4%)
  • email response (22%) or letter emailed (25%)
  • telephone query (note that not all telephone queries were included, only those where issues were raised) (13%)
  • workshop (10%)-each of nine workshops was treated as one submission
  • online submission using consultation forum (3%).

The submissions were grouped into the following categories, and the number of responses per category is shown as a percentage:

  • small industry (19%)
  • medium industry (22%)
  • large industry (10%)
  • other South Australian government departments (6%)
  • councils (19%) and council associations (3%)
  • industry associations (4%)
  • clubs eg yacht club, golf club (3%)
  • hospital (1%)
  • interstate government agencies (2%)
  • workshop (10%).

Finalisation of the details of the licence fee structure

Comments were received which assisted the EPA and the LFS Reference Group in finalising the details of the licence fee structure. Personal details of respondents and their organisations were not shared with the Reference Group.

Several changes were made to the fee structure to address the issues raised in submissions. The changes are discussed in the document entitled Changes made to Environment Protection Authority (EPA) licence fee structure to address issues raised in public consultation, May and June 2006, as well as issues raised by the Reference Group.

The consultation process was very thorough and the EPA thanks all those who provided submissions and/or attended public workshops, as well as the Reference Group members for their valuable contribution to the development of a fairer and more equitable fee structure.
