Orders
Environment protection orders (EPO) and clean up orders (CUO) are written orders that require a person or company to undertake actions to remedy a risk or prevent further environmental harm. An order is issued by the EPA under the Environment Protection Act 1993 (EP Act).
Types of orders
An order is typically issued to secure compliance with the general environmental duty, mandatory provisions of an environment protection policy, a licence condition, a condition of a beverage container approval or any other requirement imposed by or under the EP Act.
An EPO is an administrative tool that is used to secure compliance with the EP Act. For example, if a licensee is not complying with a condition of their licence, the EPA can issue an EPO to place conditions on the licensee that will bring about compliance.
A CUO is an administrative tool that can be used to rectify environmental harm that has been caused by non-compliance. For example, if a person dumps oil into a creek and pollutes the aquatic environment, the EPA can issue a CUO. If that responsible person fails to act, the EPA can issue an authorisation to a third party to carry out the clean up and then recover those costs from the responsible person.
You can search the index to find out about orders that have been issued in your suburb or town.
Blank fields mean that the order was issued to an individual rather than a corporation. The names of individual persons and corporations that have been issued an order are included on the copy.
If an order refers to a report or monitoring plan that is required to be submitted to the EPA, then it is available through the public register. Please quote the order number when making your request. Electronic copies of documents listed on the index of the public register directory will be provided for free. Fees may apply for hard copy documents.
You can request a copy of information or make an appointment to view information by contacting (08) 8204 9128 or email. Please quote the order number of the record you are interested in.
How to do the online search
- ‘Search Latest’ only searches for the current version of the record in the public register whatever is the status (eg issued, cancelled, etc) vs including historic versions.
- The search can be tailored to the 'record type' you are seeking:
- environmental authorisations (eg licence, exemption or works approval)
- applications
- environment protection order
- A 'record number' can be added to search for an exact match of the record, eg a licence number.
- Text entered into the ‘Name’ field will display the list of possible options to choose from. Some environmental authorisation may be held in a different name to their trading or business name. If you have difficulty finding an authorisation holder by their name, you may try using the ‘Suburb’ (which includes 'Town') field instead .
- A record can be searched by either the suburb, land title reference or street address.
- Records can also be searched by the prescribed activity of environmental significance as defined in Schedule 1 to the Environment Protection Act 1993 (EP Act), eg abrasive blasting.
- The search function does not accept logic searches. Do not use eg, and, or, not in the fields.
- If your search generates a long list of records you can sort the list further into fields such as licence number, licensee name or suburb by clicking on the heading at the top of the column.
